I just close a deal week ago with foreign seller. i was representing buyer in this transaction, but want to share my experience with problems that arise from one little check box mark in Residential purchase agreement (RPA)and incompetence of listing agent.

From the beginning-listing, MLS, traditional sale, cash buyer, offer, acceptance with little counter offer about closing date. Everything look great. fast closing in 15 days (by Nevada Rules), but....... When I was showing the property to my buyer I met with the seller, and she barely speak English, so when we received offer accepted I ask the listing agent to check in RPA is the seller is FIRPTA person or not. The reaction was " What- I am a listing agent" . My email answer was- yes and it is your responsibility to ask the seller and disclose. Another email saying "Young lady, I have 13 years experience, I know pretty much what I am doing" . Well my buyer ask me to proceed with this deal. I ask for disclosures- another surprise all disclosure came with wrong answers. If we did not see the property, it is look like that the house is totally destroyed and tear down. Another email to listing agent ( I love to have written evidence in my work) and answer -" You know that the house is in good condition , we will fix that disclosures". Ask for HOA Demands, listing agent send me demands from last year when she happen to be buyer agent. Another correspondence about recent statement that owner have everything paid up to date and etc. Nightmare every single day.

Finally date before closing. early in the morning phone call from listing agent and she told me"Listen young lady, we just find out that my seller do not have valid USA ID, so I am sending you documents, if you want to close, your buyer have to sign. I forgot to mention that my buyer is buying this property for investment and in our offer is checked that buyer do not have intent to occupy the property. So what was my surprise when I receive the papers that my buyer have to sign saying that he don't aware that this is foreign person and he is going to occupy the property, and also that this papers are been prepared from the title Company legal team.

I was thinking that I will explode. I do not know how to qualify that , but I decide even if I am going to lose that deal day before closing, I do not want to get involved in that fraud.

I send email to Title Company, listing agent, broker saying " ME AND MY BUYER DO NOT WANT TO GET INVOLVED IN THE FRAUD' and I wanted to write down too "AND YOUR STUPIDITY. I DID ASK YOU FOOL".

And also go fix the problem, me and my buyer will give you 3 days, or will see you in court to reimburse me and my buyer.

We close after 3 days, when the seller present proof , that apply for tax ID.
